न्याय–सम्पादक दिव्यपरीक्षणको शास्त्रीय स्वरूप

संसारका हरेक भूखण्डमा रहेका हरेक जनसमुदाय आआफ्नै धार्मिक मान्यता र संस्कारहरू रहेका छन् । ती मान्यता, संस्कार तथा विश्वासहरूको गहिरो छाप परेको हुन्छ तत्तत् देशका तत्तत् कानुनी परम्परामा । संसारको सर्वप्राचीन ग्रन्थ ऋग्वेद, अथर्ववेद, ताण्ड्यब्राह्मण जस्ता ग्रन्थहरूमा छिटपुट दिव्यपरीक्षणका संकेत पाइन्छ ।

१.१.विषयपरिचय
सामाजिक संरचनालाई सुरक्षित राख्न दण्डव्यवस्थाको आवश्यकता पर्छ ।  समाज वा व्यक्तिमाथि गलत असर पार्ने तत्त्वको निराकरण गर्न अपराधीलाई दण्ड दिने व्यवस्था गरिएको हुन्छ । दण्डनीय व्यक्तिलाई दण्डको व्यवस्था नभए बलवान्ले निर्बलमाथि हिंसा र आतङ्क मच्चाउन थाल्छ । समाजमा मत्स्यन्याय लागू हुन थाल्छ । अतः समाजलाई सुख–शान्ति प्रदान गर्न दण्डव्यवस्था अति आवश्यक हुन्छ । परन्तु दण्ड दिने काम हचुवाको भरमा हुन सक्तैन । यसका लागि ठोस आधार चाहिन्छ । त्यस आधारलाई प्राच्य–धर्मशास्त्रले प्रमाण भनेको छ । प्रमाणलाई मानुषप्रमाण र दिव्यप्रमाण गरी दुई किसिमले वर्गीकृत गरिएको पाइन्छ । मानुष वा लौकिकप्रमाणलाई योगीश्वर याज्ञवल्क्यले तीन प्रकारमा वर्गीकरण गरेका छन्  । उनका अनुसार मानुष वा लौकिक प्रमाण  लिखित, भुक्ति र साक्षी गरी तीन किसिमका छन् । यी तीन प्रमाणलाई  न्यायसम्पादनको प्रथम आधार बनाउनु पर्छ तर यी तीनवटै प्रमाण सम्भव नभएको परिस्थितिमा अलौकिक वा दिव्यप्रमाणको सहायता लिएर भए पनि मानिसलाई न्याय दिनुपर्छ भन्ने शास्त्रीय मान्यता रहेको छ ( यज्ञवल्क्यस्मृति २÷२२ ) ¬। अतः प्राच्य विधिशास्त्रमा न्यायसम्पादनको दोस्रो आधारका रूपमा प्रयोज्य मानिएको दिव्यप्रमाण बारे चर्चा गर्नु सान्दर्भिक नै हुन्छ ।

१.२.विषयविमर्श र प्राप्ति
दिव् धातुमा यत् प्रत्यय जोडिएर बनेको दिव्य शब्दले दैवी, स्वर्गीय वा अलौकिक  भन्ने अर्थबोध गराउछ  (आप्टे, १९६६, पृ.४५८ ) । यसबाट प्रमाणका सन्दर्भमा प्रयुक्त दिव्यशब्दले अप्रत्यक्ष विषयतर्फ संकेत गरेको छ । श्रीमद्भगवद्गीतामा पनि अप्रत्यक्ष अर्थमै दिव्यशब्दको प्रयोग भएको पाइन्छ ( ११÷२४७ ) । आध्यात्मिक ज्ञानका सन्दर्भमा दिव्यशब्दको विलक्षण महत्त्व रहे पनि न्यायसम्पादनका निमित्त परीक्षण गरिने लिखित, भुक्ति र  साक्षी जस्ता प्रत्यक्ष (लौकिक) प्रमाणका अघि अप्रत्यक्ष अर्थबोध गराउने दिव्यप्रमाणको गौणमहत्त्व रहने कुरामा झुक्किनु हुदैन । यसरी लौकिक वा प्रत्यक्ष प्रमाणका अभावमा प्रयोज्य प्रमाणलाई नै शास्त्रकारहरूले दिव्यप्रमाण भनेर चिनाएका छन् । संसारका हरेक भूखण्डमा रहेका हरेक जनसमूदायका आआफ्नै धार्मिक मान्यता र संस्कारहरू रहेका छन् । ती मान्यता, संस्कार तथा विश्वासहरूको गहिरो छाप परेको हुन्छ तत्तत् देशका तत्तत् कानुनी परम्परामा । संसारको सर्वप्राचीन ग्रन्थ ऋग्वेद, अथर्ववेद, ताण्ड्यब्राह्मण जस्ता ग्रन्थहरूमा छिटपुट दिव्यपरीक्षणका संकेत पाइन्छ, तर बढी स्पष्टताका निमित्त  मनुस्मृति ( ८÷११६ ) मा गरिएको व्यवस्थालाई नै दिव्यप्रमाणको सर्वप्राचीन उदाहरण मान्न सकिन्छ । यसरी नै छान्दोग्योपनिषद्, आपस्तम्ब धर्मसूत्र, नारदस्मृति, याज्ञवल्क्यस्मृति, विष्णुधर्मसूत्र, वृहस्पतिस्मृति, शुक्रस्मृति, कात्यायनस्मृतिजस्ता ग्रन्थहरूमा दिव्यप्रमाणसम्बन्धी चर्चा भएको पाइन्छ । यसरी हाम्रा धर्मशास्त्रीय न्यायपरम्परामा दिव्यप्रमाणसम्बन्धी लामो श्रृङ्खला रहेको देखिन्छ । दिव्यप्रमाणका स्वरूप के कस्ता छन् भन्ने  विषयमा शास्त्रप्रयोजकहरू एकमत भएका पाइदैनन् । मनुस्मृतिले दिव्यका यति नै भेद छन् भनेर किटानी नगरेको भए पनि यसमा अग्निदिव्य र जलदिव्यको स्पष्ट विधान रहेको पाइन्छ ( मनुस्मृति ८÷११४ ) । याज्ञवल्क्यस्मृति ( २÷९५ )का अनुसार दिव्यप्रमाण पाँच प्रकारका छन् । ती हुन् ः— १) तुलादिव्य २) अग्निदिव्य ३) जलदिव्य ४) विषदिव्य र ५) कोशदिव्य ।  वीरमित्रोदय व्ववहारप्रकाश अनुसार आचार्य वृहस्पतिले तुला, अग्नि, उदक, विष, कोश, तण्डुल, तप्तमाष, फाल र धर्मदिव्य गरी नौ प्रकारका दिव्यप्रमाणका चर्चा गरेका गरेका छन् । साथै उनले यी नौ नै प्रकारका दिव्यप्रमाणको व्यवस्था मानव धर्मशास्त्रका प्रवर्तक स्वयम्भू मनुकै निर्देशनमा व्यवस्थित गरिएको कुरा किटानी गरेका छन् (मित्रमिश्र, १९२९, पृ.१७० ) । यी नौ प्रकारका दिव्यप्रमाणहरू न्यायव्यवस्थालाई सुचारm राख्नका लागि आवश्यक लिखित, भुक्ति, साक्षी जस्ता मूल लौकिक प्रमाणका अभावमा कामचलाउ प्रमाणका रूपमा हजारौं वर्ष अघिदेखि प्रचलित रहदै आएको कुरा उपर्युक्त स्मृतिग्रन्थहरूको अध्ययनले स्पष्ट पार्दछ ।

अभियुक्तलाई दिव्यप्रक्रियामा सामेल गराउँदा देश, काल र परिस्थितिको समेत ख्याल गर्नुपर्छ । यो दुष्टपहिचान गर्ने अप्रत्यक्ष प्रमाण भएकोले अभियोक्ता, अभियुक्त तथा न्यायाधिकारी सबैले सत्य, धर्म तथा विश्वासका साथ यस प्रक्रियालाई सम्पन्न गर्नुपर्ने हुन्छ । आचार्य कात्यायनका अनुसार गम्भीर किसिमका अपराधकार्यमा संलग्न व्यक्तिहरूका लागि मन्दिरहरूमा, राजद्रोहसँग सम्बन्धित अभियुक्तहरूका निमित्त राजदरबारअगाडि, वर्णसङ्कर भई जन्मेका व्यक्तिहरूका लागि चौबाटोमा र यसभन्दा भिन्न कोटिका अपराधका  अभियुक्तलाई न्यायालयमा लगी दिव्यपरीक्षण गराउनु पर्छ ( मित्रमिश्र, १९२९, पृ.१८२ ) । यसरी धर्मशास्त्रले दिव्यविधिद्वारा मुद्दाफैसला गर्दा अपराधअनुसार उपयुक्त स्थानलाई पनि महत्त्व दिएको देखिन्छ । दिव्यपरीक्षण गर्दा परीक्षण–समय पनि मिलाउनुपर्छ । यस कार्यका लागि निश्चित ऋतु, महिना, सूर्य–सङ्क्रमण, दिन–रात, पूर्वाह्ण अपराह्ण मध्याह्न आदि कालविशेषलाई समेत ख्याल गर्नुपर्छ । पितामहस्मृतिका अनुसार चैत्र, मार्ग तथा वैशाख महिना सामान्यतया दिव्यपरीक्षणका उचित महिना हुन् । त्यसरी नै उनले दिनको पूर्वाह्ण भागमा तुलादिव्य र अग्निदिव्य, मध्याह्नमा जलदिव्य, पूर्वाह्णमै कोशदिव्य र रात्रिको अन्तिम प्रहरमा विषदिव्यको परीक्षण गर्नुपर्छ भनेका छन् (मित्रमिश्र, १९२९, पृ.१७१ ) । दिव्यप्रमाणको प्रयोग गर्दा अभियुक्तको उमेर, लिङ्ग, अवस्था आदिलाई पनि ध्यान दिनुपर्छ । शास्त्रकारहरmले पृथक्पृथक् किसिमका अभियुक्तलाई पृथक्पृथक् किसिमकै दिव्यहरूको परीक्षण गराउनु पर्ने कुरामा ध्यान दिएको पाइन्छ । स्त्रीजाति, बालक, वृद्ध, अन्ध–अपाङ्ग तथा ब्राह्मणवर्गका अभियुक्तलाई धट अर्थात् तुलानामक दिव्यप्रमाणद्वारा परीक्षण गर्नुपर्ने कुरा बताएका छन् भने क्षत्रियका लागि अग्निदिव्य, वैश्यका लागि जलदिव्य र शूद्रका लागि विषदिव्यको परीक्षण गर्नपर्छ भनेका छन् ( याज्ञवल्क्यस्मृति २÷९८) । परन्तु उपर्युक्त सम्पूर्ण दिव्यमध्ये तुला, अग्नि, जल र विष यी चारवटा दिव्यहरूको प्रयोग भने ब्रह्महत्यादि गम्भीर प्रकृतिका अभियोग लागेका व्यक्तिउपर मात्र गर्नुपर्छ भनेका छन् न्यायमनीषीहरूले । कोशादि अन्य दिव्यको परीक्षण चौर्यादि अल्पाभियोगमा गरिन्छ । प्राय सबै वर्णका अभियुक्तहरूलाई कोश, तण्डुल, तप्तमास, फाल र धर्मादि दिव्यहरूको परीक्षण गराउन सकिने शास्त्रीय मान्यता छ । 

दिव्यपरीक्षणप्रयोजनका निमित्त राजाज्ञाप्राप्त न्यायाधिकारी (प्राड्विवाक) ले राष्ट्राध्यक्ष र सभ्यब्राह्मणका अघि पूर्वाभिमुख भई अभियुक्तलाई विधिपूर्वक सम्पूर्ण दिव्यपरीक्षण गराउनु पर्ने कुरालाई योगीश्वर याज्ञवल्क्यले स्पष्ट पारेका छन् ( २÷९७) । यसरी दिव्यपरीक्षण गराउने अधिकारी र अभियुक्त दुबैजना उपवास तथा स्नानादिद्वारा शुद्ध हुनुपर्छ । न्यायाधीशले दिव्यपरीक्षणका अवसरमा अपराधी अभियोगबाट नउम्कियोस्  र निर्दोष व्यक्ति चोखियोस्  भन्ने प्रयोजनका निमित्त धर्मादि दिक्पाल र देवदेवीहरूलाई दिव्यपरीक्षणकार्यमा उपस्थित भई साक्ष्य ग्रहण गरिदिन प्रार्थना गर्छ । दिव्यपरीक्षणका क्रममा अपराधीमाथि दबाब सृजना गर्ने किसिमका मन्त्रहरूको उच्चारण हुन्छ । मानवीय बलबुताले नभ्याएको परिस्थितिमा दैवीशक्तिको आड लिएर र अभियुक्तको मानवीय कमजोरीको अध्ययनपश्चात् दिव्यको परीक्षण हुने भएकोले यसलाई सम्पादन गर्न दैवी शक्तिप्रतिको अटल विश्वास एवं मानवीय कम्जोरीको अध्ययन समेत आवश्यक पर्दछ ।  यस सम्बन्धी विस्तृत चर्चा विज्ञानेश्वरको मिताक्षरा टीका, मित्रमिश्रको वीरमित्रोदयव्यहारप्रकाश, नीलकण्ठ भट्टको व्यवहारमयूख, बालंभट्टको व्यवहार–बाल भट्टी, अर्जुन चौबेद्वारा अनुदित डा. पाण्डुरङ्ग वामन काणेको धर्मशास्त्रका इतिहास जस्ता ग्रन्थहरूमा भएको छ ।

१.२.१.तुलादिव्य
स्मृतिग्रन्थहरूमा तुलानामक दिव्यप्रमाणको चर्चा अरु दिव्यभन्दा अगाडि गरिएको पाइन्छ । यस दिव्यको परीक्षणका लागि सर्वपं्रथम खयर वा डुम्रीको वृक्षलाई वैदिक मन्त्रोच्चारणका साथ काटी दुइटा खम्बा बनाएर जमिनमुनि दुई हात गाड्नुपर्छ । जमिनबाट करिब चार–चार हात उचाइमा उत्तर–दक्षिण फर्काएर गाडिएका ती खयर वा डुम्रीका खम्बामा हूक अड्काई तराजु (तुला) बाँध्ने र अभियुक्तलाई, उसकै तौलसँग ठ्याक्कै मिल्ने गरी ढुंगा, माटो वा इट्टाका टुक्राहरूसँग नाप्ने काम गरी तुलाबाट उतारिन्छ । त्यसपछि न्यायाधीशले धर्मादि दिक्पालहरूका साथै सबै प्रसिद्ध देवदेवीहरूको आराधना गरी अभियुक्तलाई असत्यवक्ताले प्राप्त गर्ने दुष्फलको श्रवण गराउछ र सत्यतथ्य छर्लङ्ङ पार्न तुलादेवीको प्राथना गरी पहिलेकै तौल बराबरका ढुंगा, माटो वा इट्टाका टुक्राहरूसँग अभियुक्तलाई तुलामा राखी तौलिने काम गर्छ । अभियुक्तले पनि तुलादेवीलाई सम्बोधन गर्दै भन्नुपर्छ कि– हे तुलादेवि ! म साच्चै अपराधी हूं भने मलाई अघिको तौलभन्दा ज्यादा भारी बनाइदेऊ र निर्दोष छु भने हलुका बनाइदेऊ  ( याज्ञवल्क्यस्मृति २÷१०२ ) यति भन्दै ऊ तुलारोहण गर्छ । यसरी दोस्रो पटक तुलारोहण गर्दा पहिलेको भन्दा उसको वजन बढी देखियो भने ऊ दोषी ठहरिन्छ र घटी देखियो भने निर्दोष सिद्ध हुन्छ ।

१.२.२.अग्निदिव्य
यसमा पनि न्यायाधिकारी तथा अभियुक्त दुबैले स्नान उपवासादिद्वारा शरीर शुद्ध गरेर देवदेवीको पूर्ववत् आह्वान गरी पूर्ण निष्ठाका साथ दिव्यपरीक्षण गर्र्नुपर्छ । यसका लागि अग्नि, वरुण, वायु, यम, इन्द्र, कुवेर, चन्द्र, सूर्य र विश्वेदेव, यी नौका नाममा सोह्र–सोह्र अङ्गुलिका दूरीमा गोवरले वृत्त बनाउनुपर्छ र प्रत्येकमा कुश पनि राख्नुपर्छ । अभियुक्तका दुबै हातको अञ्जुली बनाई त्यसमाथि सातवटा पीपलका पात राखी सेतो धागोले बाँध्नुपर्छ । ती पीपलका पातमाथि सातवटै शमीपत्र र सातवटै दुर्वापत्रका साथै दही , अक्षता र फूल पनि राख्नुपर्छ । त्यसरी अञ्जुली बाँधी पूर्वाभिमुख भएर रहेको अभियुक्तको हातमा आगोमा बेसरी तताएर रातो पारेको फलामको डल्लो राखिदिने र उसलाई प्रथम वृत्तदेखि नवौं वृत्तसम्म पाइला टेक्दै जान लगाउनु पर्छ । यसरी तातो लौहपिण्ड अञ्जुलीमा लिएर उसले उपर्युक्त नौवटै वृत्त पार गर्नसक्यो भने ऊ शुद्ध ठहरिन्छ अन्यथा अपराधी । यसप्रकार दिव्यको परीक्षण सिद्ध हुन्छ ।

१.२.३.जलदिव्य
यो दिव्यको परीक्षण अरु दिव्यको भन्दा केही जटिल मानिन्छ । यस दिव्यको परीक्षणका लागि पनि न्यायाधिकारी र शोध्य व्यक्ति, दुबैतर्फ पूर्ववत् उपवास, शुद्धि, देवप्रार्थना आदि कार्यहरु विधिपूर्वक सम्पन्न गर्नुपर्छ । जलसम्बन्धी परीक्षण भएकोले दिव्य गर्ने र गराउने दुबै पक्षले वरmणदेवको विशेष पूजा तथा ध्यान गर्नुपर्छ । यसका लागि न्यायाधिकारी आरोपित व्यक्ति र शास्त्रोक्त गुणयुक्त सहयोगीहरm लिई निश्चित गुणपरिमाणको जलाशयमा पुग्छ । जलाशयको किनारमा आरोपितको कानसम्म   तोरण टाँगी त्यसको एकसय पचास हातको दूरीमा बाँणको लक्ष्यनिर्धारण समेत गर्छ । पवित्र वृक्षको स्तम्भ समातेर शास्त्रोक्त गुणयुक्त कुनै पुरुष पूर्वाभिमुख भई जलमा खडा हुन्छ । त्यसपछि वरुणका साथै धर्मादि देवताको प्रार्थना गर्दै न्यायाधीशले लिखित अपराधपत्र आरोपितको शिरमा राख्छ । शास्त्रोक्त गुणले युक्त एक धनुर्धरले लक्ष्यतर्फ तीन बाँणप्रहार गर्छ । आरोपितले आफ्नो सुरक्षाको लागि वरुणदेवको प्राथना गर्छ । ठीक त्यसै वेला एक युवक दौडिदै गई लक्ष्यमा प्रहार गरिएको बाँण टिपी खडा हुन्छ र तोरण टाँगिएको स्थानमा अर्को शीघ्रगामी युवक खडा हुन्छ । न्यायाधीशले तीन पटक ताली पिट्छ । उसको तेस्रो तालीसँगै आरोपित व्यक्ति जलमा खडा भएर रहेको व्यक्तिको खुट्टा समाती पानीमा डुब्छ र तत्कालै तोरणनिकट रहेको व्यक्ति तीव्रगतिमा बाँणको लक्ष्यतिर दौडिन्छ ; बाँणवाला व्यक्ति चाहिं तोरण टाँगिएको स्थानमा आउछ । यसरी आउदा उसले आरोपित व्यक्ति पानीमा डुबिरहेकै अवस्था भेट्यो भने शुद्ध ठहरिन्छ अन्यथा ऊ दोषी सिद्ध हुन्छ ( बालम्भट्ट, १९१२, पृ.३८९ )  । 

१.२.४.विषदिव्य
ब्राह्मणातिरिक्त अभियुक्तका निमित्त विषदिव्यको परीक्षण गर्ने अनुमति दिएको पाइन्छ । विधिपूर्वक महेश्वरको मूर्तिमा पूजा गरी देवप्रतिमा र ब्राह्मणको समक्षमा यो विधि सम्पादित हुन्छ । यसमा जघन्य अपराधका अभियुक्तलाई शाङ्र्ग, वत्सनाभ तथा हैमवत् मध्येका कुनै एक विषको चयन गरी रात्रिको अन्तिम प्रहरमा ऋतुअनुसारको मात्रा मिलाई त्यसमा तीसगुणा घिउ मिसाएर  अभियुक्तको अपराध उल्लेख गरी उसलाई खान दिइन्छ र निश्चित समयसम्म उसलाई विषको प्रभाव परेन भने ऊ शुद्ध ठहरिन्छ ।

१.२.५.कोशदिव्यम्
यस दिव्यको परीक्षणार्थ रुद्र, आदित्य, दुर्गा जस्ता उग्र देवताका मूर्तिलाई स्नान गराएर अभियुक्तलाई सत्येन माभिरक्ष मन्त्रको उच्चारण गरी अपराधको उल्लेख गर्दै पवित्र जलको आह्वान गरेर न्यायाधीशले तीनपटक उसलाई मूर्तिस्नान गरेको जल पिउन लगाउँछ । यसरी पिएको चौधदिनभित्र अभियुक्तको घरभित्र भयङ्कर विपत्ति पर्यो भने त्यो आरोपित व्यक्ति वास्तवमै अपराधी ठहरिन्छ, अन्यथा ऊ निर्दोष सिद्ध हुन्छ ( याज्ञवल्क्यस्मृति २÷११३ ) ।

१.२.६.तण्डुलदिव्य
चोरी वा धनसम्बन्धी विवाद अथवा कम जघन्य अपराधमा यस दिव्यको परीक्षण हुन्छ । यस विधिमा मुख्य काम के हुन्छ भने दिव्यपरीक्षण गर्नुभन्दा अघिल्लो दिनमा धानबाट सग्ला अक्षता निकाली त्यसलाई माटाको भाँडामा राखेर सुकाइन्छ । शास्त्रोक्तविधि सम्पादन गरी सूर्यदेवलाई स्नान गराएको जल राखेर त्यस अक्षतालाई भिजाई रातभर राखिन्छ र भोलिपल्ट प्रातः कालमा शास्त्रानुसार आचरण गर्ने न्यायाधीशले आरोपित व्यक्तिलाई खान दिन्छ । त्यसपछि उसलाई भोजपत्रमा थुक्न लागाउँदान थूकमा रक्तकण देखियो र चिउँडो तथा शरीर काम्न थाल्यो भने त्यो आरोपित व्यक्ति यथार्थमै अपराधी ठहर्छ भन्ने कुरालाई व्यवहारमयूख भन्ने ग्रन्थले स्पष्ट पारेको छ । 

१.२.७.तप्तमाष
यसको परीक्षण गर्दा गोलाकारमा सोह्र अङ्गुल र गहिराइ चार अङ्गुल भएको सुन, चाँदी अथवा तामाको भाँडामा घिउ वा तेलले भरी त्यसलाई बेसरी तताएर त्यसमाथि एकमासाको सुनको टुक्रो खसालिन्छ । अनि न्यायधीशले आरोपित व्यक्तिलाई उसको बूढी औंला र चोरी औंलाको प्रयोग गरी झिक्न लगाउछ । यसरी सुनको टुक्रा त्यस भाँडोबाट झिक्दाखेरि उसको हात कामेन र औंलाहरू पोलिएनन् भने सो व्यक्ति निर्दोष ठहरिन्छ । सुनको टुक्राका सट्टामा सुवर्णमुद्रिका झिक्ने अर्को व्यवस्थाको  पनि शास्त्र–प्रयोजकहरूले चर्चा गरेको भेटिन्छ ( बालम्भट्ट, १९१२, पृ.४०० ) ।
